Attorney Erick Kaardal made arguments today in the Minnesota Court of Appeals against the Faribault County Drainage Authority. The legal issue concerns whether a drainage authority improvement petition must be dismissed when a landowner identifies procedural errors in the Final Engineering Report, Viewers Report and Property Owners Report involving the government’s failure to incorporate the vested property rights associated with the original drainage ditch construction. Kaardal comments, “We are hopeful the Court of Appeals will look at the appeal from the people’s perspective.
