Attorney Erick Kaardal, as Special Counsel for the Thomas More Society, is co-counsel for Plaintiffs in a First Amendment lawsuit filed today in the U.S. District Court for the District of Idaho. The three plaintiffs were arrested, jailed and prosecuted for singing religious hymns outside city hall without masks on. The criminal charges were later dropped when it was pointed out to the prosecutors that the ordinances had an exception for First Amendment activities. Plus, two of the three plaintiffs were also arrested, jailed and prosecuted under Idaho law for resisting a police officer because they did not identify themselves. The complaint claims that the Idaho statues is unconstitutional because it compels speech when there is no reasonable suspicion of a crime.
