On August 2, the Marshall (MN) school district settled a First Amendment lawsuit brought by an association and students. The association and students complained the school district had inadequate school policies to protect the First Amendment rights of students. For example, after the school district displayed a controversial display with non-European flags and the Pride flag in the cafeteria, the school administrators suppressed speech critical of the flag display, including a student petition to take the Pride flag down. The settlement agreement included taking the controversial display down and incorporating new school district policies protecting the students’ First Amendment right to petition the school district.
