Attorney Erick Kaardal is representing complainants in Wisconsin alleging that the $8,800,000 transferred to the five largest Wisconsin cities to get-out-the-vote in targeted communities–the so-called Wisconsin Safe Voting Plan–violated the federal Constitution in two ways. First, the Wisconsin Safe Voting Plan, signed by the 5 Mayors, is a substantial departure from the state legislative scheme–thus violating the state legislature’s Article II prerogatives. Second, the Wisconsin Safe Voting Plan violates equal protection rights because the government is favoring targeting communities with additional opportunities to in-person and absentee vote compared to everyone else in Wisconsin. The Equal Protection Clause requires that every voter be treated the same in an election.
